Moving from Pennsylvania to New Jersey

Residency rules, sticky taxes, and first-year steps (2026)

2026.1 Edition · Revised 2026-07-25 · DomusDay Research

The move changes the rate; the record decides whether it sticks. Pennsylvania keeps taxing until domicile actually changes, and its 183-day statutory test stays live while any Pennsylvania abode is maintained. Below: what follows leavers, and the New Jersey steps that build the record.

Unique rule

A permanent NJ home plus 183 days keeps you a resident

Keep a permanent home in New Jersey and spend more than 183 days in the state, and New Jersey taxes you as a full resident regardless of domicile. A domiciliary escapes only with no New Jersey home, a home elsewhere, and 30 or fewer New Jersey days.

Unique rule

The famous exit tax is a refundable prepayment

Nonresidents selling New Jersey real property prepay estimated tax at closing — the top rate on the gain, never less than 2% of the sale price. It reconciles on the nonresident return, and overpayments come back.

Unique rule

The estate tax ended; the inheritance tax did not

New Jersey repealed its estate tax for deaths after 2017, but the inheritance tax remains: siblings pay 11–16% above $25,000, and unrelated heirs 15–16% above $500. Class A relatives — spouses, children, parents — are exempt.

What New Jersey adds to the record

  • A New Jersey resident working in New York pays New York tax on New York-source wages — including remote days New York treats as New York workdays under its convenience of the employer rule — with New Jersey allowing a resident credit on Schedule NJ-COJ, capped at the tax New Jersey would have charged on the same income
  • Under the Pennsylvania reciprocal agreement, a New Jersey resident's Pennsylvania wages are taxed only by New Jersey; Form REV-419EX filed with the Pennsylvania employer stops Pennsylvania withholding
  • ANCHOR and Senior Freeze enrollment become dated New Jersey-domicile markers: ANCHOR turns on the October 1 main-residence date, and Senior Freeze accrues after years of continuous residence in the home
  • Driver license transfer and vehicle title/registration share a single 60-day window after the move, or the current credential's expiration if sooner
  • Minimum auto liability limits rose to $35,000/$70,000 with $25,000 property damage on January 1, 2026, from the 25/50/25 floor set in 2023
  • The 183-day statutory test that scrutinizes leavers works in the arriver's favor: a permanent New Jersey home plus New Jersey days documents the new pattern of life

Establishing in New Jersey

The first weeks in New Jersey matter more than they look: each step below produces a dated document, and dated documents are what answer a Pennsylvania examiner years later. Do them early and the record starts on your side of the timeline.

Government registrations(3)
  • New residents transfer an out-of-state driver license within 60 days of the move or before the current license expires, whichever occurs first.

Home & property(2)
  • The ANCHOR property tax relief benefit — the successor to the Homestead Benefit — turns on occupying the New Jersey home or rental as the main residence on October 1 of the benefit year, at gross income up to $250,000 for homeowners and $150,000 for renters. Enrollment is a dated New Jersey-domicile marker the Division's factors weigh.

Section FQuestions

Frequently asked on this route

Do I still pay New York tax after moving to New Jersey?

On New York-source wages, yes — including remote days New York treats as New York workdays under its convenience of the employer rule. New Jersey allows a resident credit for the New York tax on Schedule NJ-COJ, capped at the tax New Jersey would have charged on the same income.

How are Pennsylvania wages taxed after becoming a New Jersey resident?

Under the reciprocal agreement, only New Jersey taxes a New Jersey resident's Pennsylvania compensation; Form REV-419EX filed with the Pennsylvania employer stops Pennsylvania withholding. The agreement covers wages only — self-employment and other Pennsylvania-source income still requires a Pennsylvania nonresident return.

What are the first residency steps in New Jersey?

A New Jersey driver license and vehicle title/registration within 60 days of the move (or before the current credentials expire, if sooner), voter registration by 21 days before an election, New Jersey auto insurance at the 35/70/25 minimums, and — once the home is the main residence on October 1 — an ANCHOR application. The arrival year is filed on a prorated NJ-1040.
