How long can someone stay in Louisiana without becoming a resident?

Six months. The department treats individuals who reside in the state for more than six months as residents of the state for the entire year — the whole year, not the months of presence. Alongside that count runs domicile, which does not change on a temporary absence.

What does Louisiana look at to accept a domicile change?

Actions. The department states that the intention to change domicile is confirmed by actions taken to establish a new domicile outside Louisiana, and names five: registering to vote, registering and titling vehicles, obtaining a driver's license, changing children's school of attendance, and obtaining a homestead exemption. It asks for the other state's voter registration, automobile registration, and driver's license as documentation.

Does leaving Louisiana for a work assignment change residency?

Not by itself. The department states that a temporary absence from Louisiana does not automatically change domicile for individual income tax purposes. What changes it is the set of actions establishing a new domicile elsewhere, each of which produces a dated record in the destination state.

Which Louisiana return covers the year of the move?

Form IT-540B, the nonresident and part-year resident return, reporting income earned from Louisiana sources. Residents file IT-540 on all income. Where residence in the state exceeded six months, the year is a resident year in full.

What is the Louisiana income tax rate now?

A flat 3% on all taxable income for periods beginning on or after January 1, 2025, replacing the graduated brackets, with the standard deduction raised to $12,500 for single filers and $25,000 for joint filers. Capital gains sit in the same base at the same rate.
