The Hall tax on interest and dividends is gone

Tennessee never taxed wages. Its one personal income tax, the Hall tax on interest and dividends, phased down through 2020 and was repealed for tax years beginning January 1, 2021. The Department of Revenue instructs taxpayers not to file a return for any year beginning on or after that date.

In 2014, Tennessee voters wrote the ban into Article II §28: the legislature shall not levy, authorize, or otherwise permit any state or local tax upon payroll or earned personal income. Reversing it would take another constitutional amendment — two legislative sessions plus a statewide vote.

Tennessee has no state income tax on earned income and no withholding requirements, and with the Hall tax repealed there is no personal income tax return at all. The state's revenue arrives instead through consumption taxes: a 7% state sales tax plus local rates up to 2.75%.

How many days out of Alabama end residency?

There is no such number. Rule 810-3-2-.01 taxes those domiciled in Alabama on their entire income regardless of physical presence during the year, so days out of state do not end residency by themselves. What ends it is a new domicile established elsewhere coupled with abandonment of the Alabama one — presence plus intent, both shown by dated facts.

Who has to prove the domicile change?

The taxpayer. The rule requires physical presence in the new jurisdiction plus intent to establish domicile there, coupled with abandonment of the old, and places the burden of proving a change on the person asserting it. Registrations, the disposition of the Alabama dwelling, and the county homestead record are the dated pieces.

What happens to Alabama workdays after leaving?

Wages for personal services performed in Alabama stay Alabama-source for a nonresident. Act 2025-334 excludes an employee who works 30 or fewer days in the state during the calendar year, performs duties in more than one state, and lives in a state with a similar exclusion or no income tax; past 30 days, all Alabama-earned income for the year is taxable.
